1. Introduction
These Terms & Conditions (“Terms”) govern your access to and use of effectivepmc.com and all related content, communications, corporate training engagements, and public certification Programs (collectively, the “Platform” and “Programs”) offered by Effective PMC Pvt. Ltd. (“EPMC,” “we,” “us,” or “our”), a company incorporated in India.
World of Agile is a brand owned and operated by EPMC, offering public and corporate certification training under the World of Agile name via worldofagile.com. References to “EPMC,” “we,” or “our” in these Terms include activities conducted under the World of Agile brand, unless the context requires otherwise. Where you register or transact through worldofagile.com specifically, the World of Agile Terms & Conditions apply to that transaction as the brand-specific terms, with these EPMC Terms applying to the parent corporate entity and to all engagements conducted directly under the EPMC name (e.g., corporate training and consultancy services).
By accessing the Platform, submitting an enquiry, registering for a Program, or engaging EPMC for corporate training or consultancy services, you agree to be bound by these Terms, our Privacy Policy, and our Cancellation & Refund Policy (incorporated herein by reference and available at effectivepmc.com/terms-policies). If you do not agree, please discontinue use of the Platform.
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices.
2. Our Services
EPMC provides professional training, consultancy, and coaching services in project management and Agile practices, including but not limited to: public certification training (delivered under the World of Agile brand) accredited by bodies such as Scrum Alliance and Scaled Agile, Inc.; corporate/private training engagements customized for organizations; and Agile coaching and consultancy services.
EPMC is a Scrum Alliance Registered Education Institute. Certain Programs may be subject to additional policies imposed by the relevant accreditation body, which apply in addition to these Terms.
3. Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to register for a Program or engage EPMC’s services independently. If you are registering or engaging on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
By registering or engaging our services, you represent that all information you provide is accurate, current, and complete, and you agree to update it as needed.
4. Public Training: Enrollment, Fees & Payment
4.1 Registration
Enrollment in a public Program (including those delivered under the World of Agile brand) is confirmed only upon receipt of the applicable registration fee and issuance of a confirmation email. It is your responsibility to review the course dates, format, trainer, and fee details before completing payment.
4.2 Fees & Taxes
All fees are quoted in the currency displayed at checkout and are exclusive of applicable taxes (e.g., GST) unless otherwise indicated. You are responsible for any bank charges, currency conversion fees, or payment gateway charges incurred in making payment.
4.3 Payment Processing
Payments are processed through third-party payment gateways. EPMC does not store your full card or banking credentials; such information is handled directly by our payment partners in accordance with their own security standards and terms.
5. Cancellations, Rescheduling & Refunds
Our full Cancellation & Refund Policy is published separately at effectivepmc.com/terms-policies and is incorporated into these Terms by reference. A summary of key terms for public, paid classroom and virtual training is provided below; in the event of any conflict, the dedicated policy page governs.
5.1 Cancellations & Reschedules by You
- Cancellation requests received within 24–48 hours of registration are eligible for a full refund.
- Cancellation requests received 7 or more calendar days before the training date are eligible for a refund, less a 20% processing charge.
- Cancellations made 1–3 days before class, and no-shows, are not eligible for a refund (except for documented medical or national emergencies); reschedules in such cases are at EPMC’s discretion.
- Reschedule requests received 10 or more calendar days before the training are credited toward a future training date at no extra charge.
- Reschedule requests received less than 10 days before the training are credited to a future date but attract an additional 10% of the course fee as a reschedule charge (waived for documented medical or national emergencies).
- Registrant substitutions may be made at any time before the course.
- If you do not notify us, cancel, or attend, you will not be offered a refund or reschedule.
- All refunds are made via the original mode of payment and may take 5–7 business days to process.
5.2 Cancellations & Reschedules by EPMC
EPMC reserves the right to cancel or reschedule a class at any time, including for insufficient registrations, classroom or trainer unavailability, or unforeseen circumstances. In such cases, you will not be charged for the training and will be offered, at your choice, a full refund or full credit toward a future workshop. Please consult an EPMC Training Coordinator before making travel arrangements for a training, as EPMC is not liable for direct, indirect, consequential, or special damages arising from a class cancellation, including travel or accommodation cancellation penalties.
5.3 Corporate & Private Training Engagements
Cancellation, rescheduling, and payment terms for customized corporate training or consultancy engagements are governed by the specific commercial agreement (proposal, SOW, or purchase order) executed between EPMC and the client organization. Where no such agreement exists, the public training terms in Section 5.1 apply as a default.
6. Program Delivery & Changes
EPMC reserves the right to modify trainers, course content, schedules, delivery mode (classroom/virtual), or platform for operational reasons, provided the core learning objectives and any applicable accreditation requirements are preserved. You are responsible for ensuring you have a stable internet connection, a compatible device, and any required software to participate in virtual sessions.
7. Certification & Accreditation
Certifications such as CSM®, CSPO®, A-CSM®, A-CSPO®, CSP®-PO, and SAFe® credentials are issued directly by the relevant accreditation body (Scrum Alliance or Scaled Agile, Inc.) — not by EPMC — and are subject to that body’s own eligibility criteria, renewal terms, and code of conduct. EPMC facilitates enrollment and delivers the training but has no authority over the accreditation body’s decision to award, withhold, or revoke a credential.
Where EPMC or World of Agile issues its own skill badges or certificates of completion (e.g., “AI for Agile Professionals,” “Agile Project Management,” “Practical Kanban”) that are not third-party accredited, these represent completion of internal training only and do not carry external accreditation unless explicitly stated on the relevant course page.
8. Intellectual Property
All course materials, presentations, videos, quizzes, workbooks, templates, trademarks, logos, and other content made available through the Platform, Programs, or corporate engagements (“EPMC Content”) are the property of Effective Project Management Consultancy Pvt. Ltd. and/or its licensors and accreditation partners, and are protected under Indian copyright, trademark, and other intellectual property laws. “World of Agile” and associated branding are trademarks/brand assets of EPMC.
CSM®, CSPO®, CSD®, CSP®, A-CSM®, A-CSPO® and related marks are registered trademarks of Scrum Alliance. SAFe® and the Scaled Agile Framework® are registered trademarks of Scaled Agile, Inc. These marks are used with permission or under license and remain the property of their respective owners.
You may access and use EPMC Content solely for your personal or your organization’s internal, non-commercial learning purposes in connection with your enrolled Program or engagement. You may not copy, reproduce, republish, distribute, sell, sublicense, or create derivative works from EPMC Content, or share login credentials or course access with unauthorized third parties, without our prior written consent.
9. User Conduct
By using the Platform or attending a Program or engagement, you agree that you will not:
- Harass, discriminate against, or create a hostile environment for other participants, trainers, or staff;
- Cheat on any assessment, exam, or assignment, or share secured testing materials without authorization;
- Record, redistribute, or publicly share live session content without EPMC’s written consent;
- Use the Platform for any unlawful purpose or in violation of applicable law;
- Attempt to gain unauthorized access to the Platform, other users’ accounts, or EPMC’s systems.
We reserve the right to remove a participant from a live session, revoke Platform access, or decline further enrollment where these conduct standards are violated, without obligation to refund fees already earned for services rendered.
10. Confidentiality (Corporate Engagements)
Where EPMC is engaged for corporate training or consultancy services, both parties agree to keep confidential any proprietary business information, internal processes, or data shared in connection with the engagement, and to use such information solely for the purpose of delivering the agreed services, except where disclosure is required by law or separately agreed in writing.
11. Third-Party Links & Tools
The Platform may contain links to third-party websites, tools, or resources (e.g., accreditation body portals, payment gateways, scheduling tools). EPMC does not control and is not responsible for the content, accuracy, or practices of these third-party sites.
12. Disclaimer of Warranties
The Platform, Programs, and consultancy services are provided on an “as is” and “as available” basis. While we strive for accuracy and reliability, EPMC makes no warranty, express or implied, that the Platform will be uninterrupted, error-free, or secure, or that course content or consultancy advice will guarantee any specific business, career, examination, or certification outcome.
13. Limitation of Liability
To the maximum extent permitted by applicable law, EPMC, its founders, trainers, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages (including loss of profits, data, business opportunity, or goodwill) arising from your use of, or inability to use, the Platform, Programs, or consultancy services. Where liability cannot be excluded, EPMC’s total liability to you for any claim shall not exceed the amount of fees actually paid by you or your organization for the specific Program or engagement giving rise to the claim.
14. Indemnification
You agree to indemnify and hold EPMC and its trainers, employees, and affiliates harmless from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of your breach of these Terms, your violation of any law or third-party right, or content you submit through the Platform.
15. Privacy
Our collection and use of your personal information is governed by our Privacy Policy, available at effectivepmc.com/privacy-policy, which forms part of these Terms. By using the Platform, you consent to the collection and processing of your data as described therein, including for the purpose of sharing your progress or completion status with relevant accreditation bodies where required for certification.
16. Termination
EPMC may suspend or terminate your access to the Platform, a Program, or a services engagement, without prior notice, where you materially breach these Terms — including through misconduct, non-payment, or misuse of course materials. Termination for cause does not entitle you to a refund of fees already earned for services rendered, subject to Section 5 where applicable.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or your use of the Platform or services shall first be addressed through good-faith negotiation between the parties. If unresolved, such disputes shall be subject to the exclusive jurisdiction of the competent courts at Thane / Mumbai, Maharashtra, India.
18. Miscellaneous
18.1 Force Majeure
EPMC shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, epidemics, internet or utility failures, governmental action, or civil unrest.
18.2 Severability
If any provision of these Terms is found unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18.3 Entire Agreement
These Terms, together with our Privacy Policy and Cancellation & Refund Policy (and, for corporate engagements, any executed SOW or agreement), constitute the entire agreement between you and EPMC regarding your use of the Platform and services.
18.4 Relationship to World of Agile Terms
Where a conflict arises between these EPMC Terms and the World of Agile Terms & Conditions for a transaction conducted specifically through worldofagile.com, the World of Agile Terms shall govern that specific transaction, and these EPMC Terms shall govern all other matters, including corporate identity, IP ownership, and engagements conducted directly under the EPMC name.
